Who can be the owner of an EU trademark?

There is no restriction on owning an EU trademark. Any individual or company can own an EU trademark, and small business or worldwide business owners can apply for an EU Trademark.

The owner must be kept up to date while applying accurate details of the proprietor of the mark, not to doubt who owns the mark and make the correct application.

If you are applying for EU Trademark as a company, you must provide the following information:

  • Full name and legal name
  • Country of registration
  • Address

If you are applying as an individual, you must provide the following information:

  • Name and surname
  • Nationality

How long is an EU trademark valid?

According to EUTMR, a European Union trademark is valid for ten years. Article 52 of the regulation states that “EU trade marks shall be registered for ten years from the date of filing of the application, and registration may be renewed for further periods of 10 years.”

There are conditions for EU trademark renewal. They are:

  1. Filing an explicit request for renewal of the registration in the six months before the expiry;
  2. Payment of fees.

The request for renewal of the trademark and fee payment must be made within six months before the expiration date. A renewal application cannot be made after its expiration.
